CRG Terms of Service

By reading this TOS notice you hearby agree to the terms stated within, which remains in affect for the duration of your account being placed with CRG Hosting Company. ----------------------------------- Media Content (Your Files) ----------------------------------- As a customer of CRG Hosting Company you are responsible for the care and maintenance of your account at all times. This includes purging and backing up media on regular intervals. A backup should be performed after any significant changes have been made to your account. Based on mutual agreement, an administrator may save your files for you on a remote source, ie. compact disk or dvd, external drive, and is responsible for making those files available to you upon written request, in a timely manner.

Customer and Server Security ---------------------------------- At all times the customer is responsible for the security of their site/account. A listing of authorized users is kept on file and may be referenced by technical staff before giving information or assisting technically. Authorized users can only be given to the owner of CRG Hosting Company in writing (email), made by the owner of the account. If you are paying for an account for someone else, that does not authorize you as an owner in any way, unless stated as such by the means listed above. Should an account become damaged due to malicious activity from an authorized user, or should a member of your account no longer be authorized by the owner, it is in the owner's best interest to notify CRG as quickly as possible. Server security includes regular reviews of media installed that may be scanned by an antivirus program. Illegal content such as file-sharing programs are strictly forbidden. Adult content is permitted based on the residential laws of the actual server location. A single violation will result in a written warning should these files remain in a customer account. A second violation may result in immediate closure of the account.

Abuse \| Disputes ------------------------------------------ CRG Hosting Company will not become involved in your disputes with other companies. We will however make an attempt at gaining what may be rightfully yours during a transition period between companies. Before filing an abuse claim against another user, please consider the facts. A ban from the server may be the end result of your claim however this is not always the case. In the event someone has breached the security of your account, legal prosecution may be possible and based on the descretion of the owner of CRG. A security breach or "hack" is prosecutable throughout the United States. Account owners should initially take measures to protect their accounts and users by utilizing the software available at hand. Placing a ban on a user is fully permitted. Continued access by an offender once all areas have been thoroughly researched may result in a full server ban. Please include full details to the owner or administrator of CRG for further assistance.

Adult Content \| Rating Systems \| Owner Responsibility --------------------------------------------------------------------- CRG Hosting Company sternly requires ALL accounts hosted (Palace, Radio, I-Palace, Web) to properly and openly state warnings for adult content if such media is present and can be accessed publicly. CRG is based in the United States and regardless of what country you reside in, all customers are required to follow the laws and statues based on the United States. In our efforts to protect children against aggression, pedophllia and other harmful occurances, any account not found to be adhering to this policy will be immediately terminated. A minor is considered anyone under the legal age of 18. Based on the respective rating systems in each department we provide services for, any account with adult content unsuitable for minors (nudity or sexually explicit material) must be listed with a rating appropriate for it's design. It will be the responsibility of the account owner (named person or persons on original order) to properly maintain these guidlines at all times. Should a rating for any account come into question the owner will be contacted and given the opportunity to adjust their listing within 24 hours. CRG will not be engaged in approving or disproving media for each account. Nudity is defined as anything which may show genitalia of either gender, front or back. The question to ask yourself is: Would this be appropriate for your children to see? A public posting is required at entry points of your account stating it may contain adult material. CRG Hosting is not here to censor accounts however will take the means necessary to protect minors. There are cases where a minor may gain access to your account by deceiptful means. In such instances the owner will not be responsible for the actions of such an individual provided the account is properly marked and listed.

Cancellations \| Closures \| Policy Changes ---------------------------------------------------- Cancellation of an account must be in writing to the Owner before the account's next due date for renewal. We ask that you please be considerate in sending your cancellation notice at least 14 days prior to it's expiration in order to make proper arrangements for you to gather your materials before the account is removed from the server. No refunds will be issued for accounts closed before the contract period expires unless negotiated between the host and customer. CRG Hosting Company reserves the right to terminate an account at any time and without notice. Terminations will be the result of such things as TOS Violations, harassing of technical support staff, or banning them from any CRG hosted account. Our staff listing is made public for our customers to review at any time. Account owners are responsible for the actions of their staff and also may be held responsible for their actions should they place a ban on our technical support team. No refund will be issued for any account that is terminated before the contract period expires. Any issues or concerns you have regarding the actions of the technical teams should be brought to the owner's attention immediately, supported in full with a detailed log of their interactions. Any technician found to be violating our internal policies will have appropriate action taken against them, and may include the immediate termination of their position. CRG Hosting Company reserves the right to change the policies outlined on this page at any time and without notice. These changes will occur based on new or ammended laws in the United States, or to clarify the wording that may have been previously stated.

Payment \| Refunds \| Account Abandonment \| Change of Ownership ------------------------------------------------------------------------------------- Account setup requires payment in hand before processing. At the time your order is received an administrator will contact the potential account owner for review of the details and to establish payment arrangement. Based on the arrangement to make payment the account will remain pending until payment is received unless otherwise negotiated. A refund may only be issued if an account is involuntarily unavailable (offline) for a period of 10 business days for a server related issue. This would include hardware failure or other mechanical issues that fall outside of CRG Hosting Company's immediate ability to repair. However this does not include circumstances based on software malfunction, programming, server relocation, or user error. Abandonded accounts will remain open until the date of the next payment renewal. At that time the account will be closed and deleted if there has been no contact from the original owner. CRG Hosting Company will not turn the account over to an authorized user or member for any reason, unless written notice of the Change of Ownership has been received by our administration prior to the expiration date. A Change of Ownership may take place at any time by written notice. From that point on the new owner of the account retains the right to close, relocate, or renew the account.
